Terms of sale.

1. About these terms

These Terms of Sale govern your purchase of instruments from Laika Guitars at laikaguitars.us. The seller is Nick Silny, doing business as Laika Guitars, 3037 Hopyard Rd, Pleasanton, CA 94588, USA. By placing an order you agree to these terms. They apply to buyers in the United States and the European Union.

Returns, warranty and remedies are set out in full in our Return policy and warranty, which forms part of these terms.

2. Our instruments are made to order

Each Laika instrument is custom-built to the configuration you choose. Production begins only after full payment clears, and your exact specification is confirmed with you in writing before we build. An instrument that matches the accepted specification is not defective by reason of the specification itself.

3. Orders, prices and payment

Prices are shown in US dollars and, unless stated otherwise, exclude taxes and import duties. Full payment is required to start production.

We accept card (via Stripe), PayPal, Venmo and cryptocurrency (ETH); for crypto and manual methods we confirm the exact amount before you pay. We do not receive or store your full card number.

A contract forms when we confirm your order and specification in writing. We may decline or cancel an order, with a full refund, if it cannot be fulfilled or if payment is not verified.

4. Production time, shipping and duties

Build lead times are good-faith estimates given at confirmation, not guarantees; reasonable delays do not entitle the buyer to cancellation or refund. We keep you updated and send photos during the build.

We ship worldwide. Import duties, taxes and customs fees, where applicable, are the buyer’s responsibility. Risk of loss passes to you when the instrument is handed over to the carrier.

5. Cancellation and the EU right of withdrawal

Because every instrument is custom-made to your specification, it is exempt from the 14-day right of withdrawal under the EU Consumer Rights Directive (Art. 16(c)) and cannot be returned for change of mind. This does not affect your statutory rights if the instrument is faulty. See the Return policy and warranty for defect claims.

6. Warranty

Every Laika instrument carries a 2-year limited warranty against manufacturing defects, as set out in full in the Return policy and warranty. EU buyers also have the statutory legal guarantee of conformity, which applies alongside this warranty.

7. Liability and governing law

To the maximum extent permitted by law, our total liability for any order is limited to the amount you paid for it, and we are not liable for indirect, incidental, special or consequential losses. Nothing in these terms limits liability that cannot be limited by law, including mandatory consumer-protection rights.

These terms are governed by the laws of the State of California, USA, without prejudice to mandatory consumer protections in your country of residence; disputes are subject to the state and federal courts located in California. Contact: laikaguitars@gmail.com.
