1. Who we are

Laika Guitars ("we", "us", "our") is operated by Nick Silny, doing business as Laika Guitars, 3037 Hopyard Rd, Pleasanton, CA 94588, USA. For any privacy question or request, email laikaguitars@gmail.com.

This policy explains what personal information we collect through laikaguitars.us and when you order an instrument, why we collect it, who we share it with, and the rights you have. It covers visitors in the United States and the European Union / EEA.

2. What we collect

Order and enquiry details you give us through our contact form, custom-order form and crypto-order form: your name, email address, phone number and shipping address, together with any message or configuration you send.

Payment information is handled by our payment providers. We do not receive or store your full card number: card payments are processed by Stripe, and other payments by PayPal, Venmo, or a blockchain address you send to.

Technical data your browser sends to our server automatically (IP address, user-agent and pages requested) in standard server logs, used to keep the site secure and running.

We do not run analytics, advertising or behavioural-tracking tools, and we do not build advertising profiles.

3. Why we use it, and our legal basis

To take, confirm, produce and ship your order and to answer your enquiries — performance of a contract (GDPR Art. 6(1)(b)).

To keep the site secure and prevent fraud and abuse — our legitimate interests (Art. 6(1)(f)).

To meet tax, accounting and consumer-law obligations — legal obligation (Art. 6(1)(c)).

Where we ever ask for it explicitly, such as a marketing email — your consent (Art. 6(1)(a)), which you can withdraw at any time.

4. Who we share it with

We share personal data only with service providers who help us run the business, each acting under contract on our behalf: Stripe, PayPal and Venmo for payments; FormSubmit for delivering contact-form submissions to our email; Google (Gmail), which hosts laikaguitars@gmail.com; shipping carriers to deliver your instrument; and Google/YouTube for the embedded demo videos on the sound-demos page.

We do not sell or rent your personal information, and we do not share it for cross-context behavioural advertising.

5. International transfers

We operate from the United States, so if you are in the EU/EEA your data is transferred to and stored in the US. Where required, such transfers rely on the European Commission’s Standard Contractual Clauses or an equivalent safeguard.

We do not appoint an EU representative under GDPR Art. 27: our sales to the EU are only occasional and low-risk and involve no large-scale or special-category data, so we rely on the Art. 27(2) exemption for occasional processing.

6. How long we keep it

We keep order records for as long as needed to fulfil the order and honour the warranty, and afterwards only as long as tax and accounting law requires (typically seven years). Enquiry messages that do not lead to an order are deleted within twelve months.

7. Your rights

EU/EEA (GDPR): you can access, correct, delete, restrict or object to processing, request portability, and withdraw consent; you may also complain to your national data-protection authority.

United States (including California’s CCPA/CPRA and similar state laws): you can request to know, access, correct and delete your information, and opt out of the "sale" or "sharing" of personal information — which we do not do. We will not discriminate against you for exercising these rights.

8. Security, children and changes

We protect the site with HTTPS, restricted server access and other safeguards, though no method of transmission or storage is perfectly secure. The site is not directed to children under 16 and we do not knowingly collect their data.
